John Keely, who claims that he was refused when he brought three of his childeren to the restaurant to have a meal brought the case against Enzo’s after he was turned away on Christmas Eve, three years ago.

He claimed that he visited the restaurant between 3.30 and 4pm on the day and was refused service.

The Restaurant, who were represented by Richard R O’Hanrahan Solicitors, stated that Mr. Kealy turned up at the restaurant at 4.10 pm and that the restaurant closed at 4pm to allow its staff to go home early for Christmas.

The tribunal found Mr. Kealy’s testimony to be “inconsistant and less than convincing,” and ruled that he was not discriminated against contrary to the Equal Status Act.
